1. Acceptance of These Terms
These Terms of Service ("Terms") govern your access to and use of the website https://www.alsteelroofing.com (the "Site") and the purchase of products and services from ALSTEEL ROOFING INC, doing business as AlSteel Metal Manufacturing ("AlSteel," "we," "us," or "our"). By using the Site, requesting a quote, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or our services.
2. About Us
AlSteel Roofing Inc. is a metal roofing manufacturer located at 17121 Cam Court, Suite 2, Fort Myers, FL 33967. We manufacture and supply metal roofing panels, trims, flashings, architectural metal components, and roofing accessories, and we provide on-site roll forming, custom metal fabrication, and material estimating support for contractors, builders, developers, and property owners.
3. Quotes and Estimates
Quotes are prepared based on the measurements, specifications, colors, gauges, and profiles provided or approved by you. Quotes are valid for the period stated on the quote document and are subject to material availability and to changes in steel and aluminum pricing. A quote is not a binding contract until accepted by you and confirmed by us in writing.
You are responsible for the accuracy of all measurements, dimensions, quantities, and specifications you provide or approve, including any third-party measurement report. AlSteel is not responsible for material shortages, overages, or fabrication errors resulting from inaccurate or incomplete information provided or approved by the customer.
4. Orders and Payment
Orders are confirmed once payment terms have been satisfied and the order has been released to production. Unless otherwise agreed in writing, full payment is required before an order enters production. Applicable Florida sales tax will be added unless a valid resale or exemption certificate is on file with us.
5. Custom and Made-to-Order Products
Metal panels, trims, flashings, and fabricated components are manufactured to your specifications. Once an order has been released to production, it cannot be cancelled, returned, or refunded, because the materials are cut and formed specifically for your project. Requests to change an order after release to production are subject to our written approval and may incur additional charges.
6. On-Site Roll Forming
On-site roll forming is a fabrication service in which panels are manufactured at your project location. It does not include roofing installation, tear-off, structural work, or any labor beyond the fabrication of panels, unless expressly stated in a written agreement. The customer is responsible for providing safe, level, and accessible space for our equipment and crew, for site access and permitting, and for the receipt, handling, and protection of panels once fabricated. Scheduling is subject to weather and equipment availability.
7. Delivery, Pickup, and Inspection
Delivery and pickup dates are estimates and are not guaranteed. You must inspect all materials at the time of delivery or pickup and note any shortage, visible damage, or discrepancy on the delivery documentation at that time. Claims for shortage or visible damage must be reported to us within 48 hours of delivery or pickup. Risk of loss passes to the customer upon delivery or pickup.
8. Warranty
Metal roofing systems supplied by AlSteel may be eligible for a manufacturer warranty of up to 35 years from the metal manufacturer. Eligibility requires that a complete roofing system, including panels, underlayment, and accessories, be purchased directly from AlSteel. Warranty terms, coverage, exclusions, and duration are established and administered by the metal manufacturer, and the manufacturer's written warranty document governs.
The following are inherent characteristics of metal roofing products and are not defects: minor waviness or "oil canning" in flat panel areas, slight variation in color or gloss between production runs, and normal weathering. Warranties do not cover damage resulting from improper installation, improper handling or storage, alteration, incompatible materials or fasteners, foot traffic, abrasion, standing water, chemical exposure, or acts of nature.
AlSteel does not warrant the workmanship of any third-party installer.
9. Text Messaging (SMS and MMS)
If you provide your mobile number and check the marketing consent checkbox in our website chat widget, you agree to receive marketing text messages from AlSteel Roofing Inc at the number provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time, or HELP for assistance. Mobile carriers are not liable for delayed or undelivered messages. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. 10. Use of the Site
You agree not to use the Site to violate any law, to interfere with its operation or security, to attempt unauthorized access to any system, to use automated tools to scrape or harvest content, or to submit false, misleading, or another person's information. You are responsible for the accuracy of any information you submit.
11. Online Store
Products purchased through our online store are subject to these Terms in addition to any product-specific terms shown at checkout. Prices, availability, and product specifications are subject to change without notice. We reserve the right to correct pricing errors, limit order quantities, and refuse or cancel any order, including after an order has been submitted, with a refund of amounts paid for the cancelled portion.
12. Intellectual Property
The Site and its content, including text, images, project photography, logos, product drawings, specification sheets, and the AlSteel name and marks, are owned by AlSteel or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from this content without our prior written permission.
13. Disclaimers
Except for warranties expressly provided in writing, our products and services are provided "as is" and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Information on the Site, including specifications, drawings, and code approvals, is provided for general reference. It is the responsibility of the customer, designer, and installer to confirm that products, details, and assemblies are appropriate for the project and compliant with applicable building codes, product approvals, and permit requirements.
14. Limitation of Liability
To the maximum extent permitted by law, AlSteel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, delay damages, loss of use, or labor or removal and replacement costs, arising out of or relating to our products, services, or the Site. Our total aggregate liability for any claim will not exceed the amount you paid to AlSteel for the specific product or service giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless AlSteel and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your provision of inaccurate measurements or specifications, your handling, storage, or installation of our products, or your violation of any law or third-party right.
16. Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including hurricanes and severe weather, natural disasters, fire, labor disputes, material shortages, supplier delays, transportation disruptions, utility or equipment failure, acts of government, or civil unrest.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms, our products, or our services will be brought exclusively in the state or federal courts located in Lee County, Florida, and you consent to the jurisdiction and venue of those courts.
18. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy and any written quote, order acknowledgment, or agreement signed by us, constitute the entire agreement between you and AlSteel regarding the subject matter.
19. Changes to These Terms
We may update these Terms at any time. The updated version will be posted on this page with a revised "Last updated" date and applies to orders placed after posting.
